Booking:
All bookings require:
- Full payment for the activity
- Acceptance of all our terms and conditions (general conditions of sale)
- Acceptance of the conditions of access to the activities (age, weight, number of participants, etc.). No refund will be given if access to the activity is refused by our teams because the customer does not comply with the access conditions specified for the chosen activity.
It is the client’s responsibility to check the conditions of access to the chosen activity before validating his/her purchase. Esterel Aventures cannot be held responsible for any booking errors.
Esterel Aventures cannot be held responsible in the event of bodily injury or material damage resulting from misuse of the equipment or fraudulent use. If, unbeknownst to the team members, more people than planned board the boat, Esterel Aventure cannot be held responsible and the equipment may be withdrawn without any possible compensation for the offenders.
Bachelor party/Bachelorette Party/GROUPS (more than 5 pers.):
To confirm the booking, we require a deposit of 50% of the total cost of the quote to be paid by bank transfer.
It is necessary to specify the reference of this quote in the transfer order.
Payment of the deposit constitutes acceptance of this quotation and of all our general terms and conditions of sale, which are available on www.esterel-aventures.com.
It also constitutes acceptance of the conditions of access to the activities (age, clothing, licence, deposit check, etc.).
Changes
Changes to the choice of activities are possible subject to availability and if the activities are at the same price. Otherwise, a new booking will be required.
A change of timetable is possible subject to availability until D-7.
An increase in the number of participants is possible subject to availability and will result in a change to the price.
No changes can be made less than 96 hours before the activity.
If on the day of the event the number of participants is lower than that indicated, the total amount will be due and no refund can be requested by the customer.
Refunds
Esterel Aventures reserves the right to refuse access to activities if participants do not respect the conditions of access specified by Esterel Aventure or the laws (e.g. highway code) or display behaviour that is detrimental to the safety or respect of team members, other users or the participants themselves. In such cases, NO refund will be given.
If you are unable to take part in an activity, we ask you to let us know 96 hours minimum before the activity. If this is not the case, we will be able to change the date if possible, but no refund will be given.
Late arrivals
Any delay of more than 15 minutes in relation to the meeting time will result in cancellation of the activity, with no refund or postponement possible.
A late arrival will not delay your scheduled return time, so your booking will be shortened as the equipment must be returned on time
For water sports activities, equipment must be returned on time, for everyone’s comfort. Any delay of more than 5 minutes will be billed.
For buggy rides: No refund or postponement will be made if you are more than 15 minutes late for the meeting time (set 30 minutes before the ride departure time). No refunds will be made for cancellations made by the customer 96 hours before the activity.
Cancellation clauses
In the event of cancellation by the client, or due to exceptional circumstances beyond the control of ESTEREL AVENTURES, of all or part of the services booked by the client, penalties will be applied as follows, for all services in the Esterel Aventures catalogue:
INDIVIDUALS :
– 100% for cancellations received within 4 days (96 hours)
Bachelor party/Bachelorette Party/GROUPS (more than 5Pax)
A €25 handling fee will be deducted from all cancellations, in addition to the following penalties.
-100% on D-4
– 50% on D-7
– 25% on D-15
For cancellations made before D-15, only €25 per booking will be deducted.
For buggy rides: No refunds or postponements will be made if you are more than 15 minutes late for the meeting time (set at 30 minutes before the ride departure time). No refunds will be made for cancellations made by the customer 96 hours before the activity.
Weather and force majeure clauses
ESTEREL AVENTURES cannot be held responsible for any cancellation or postponement of a tour, in particular due to adverse weather conditions, breakages during previous tours or force majeure, nor for the consequences thereof for the hirer, and undertakes to refund the deposit paid.
Estérel Aventures undertakes to maintain a programme from its catalogue depending on the weather or safety conditions for your participants.
Estérel Aventures undertakes, in the event of inclement weather preventing the activities from running smoothly, to offer a postponement of the activity within the limits of the places available.
Estérel Aventures reserves the right to decide whether or not the activities are feasible.
Force majeure
ESTEREL AVENTURES cannot be held responsible if the non-execution or delay in the execution of one of its obligations described in the present general conditions of sale results from a case of force majeure. In this respect, force majeure is defined as any external, unforeseeable and irresistible event within the meaning of article 1148 of the French Civil Code.
Duration of the buggy ride
The duration of the ride, set at 2 hours, includes the departure briefing, administrative formalities and takes effect when the equipment is made available to the customer.
Professionals
BOOKING
The reservation is effective upon signature of this estimate, dated, signed and stamped. The price of the service indicated on the order form is a guaranteed minimum package for ESTÉREL AVENTURES. Payment of a deposit of 50% of the total cost of the service constitutes full acceptance of the offer.
CANCELLATION CLAUSES
In the event of cancellation by the client of all or part of the services booked, penalties will be applied as follows:
From the date of signature of the quotation: 15% From 90 to 61 days before the operation: 50
From 60 to 30 days before the operation: 75% From 29 days to D-Day before the operation: 100%.
Weather conditions on D-4
Estérel Aventures cannot be held responsible in the event of bad weather on D-Day. Any change to the programme, interruption of the programme or adaptation will under no circumstances result in a refund of the event; the full amount of the service will be due. Estérel Aventures undertakes to maintain a programme from its catalogue depending on the weather or safety conditions for your participants.
BALANCE OF THE SERVICE
The balance of the service will be paid on receipt of the invoice at the end of the event and will be due within 7 days. Penalties may be applied for any costs inherent in a recovery procedure.
Individuals & Professionnals
Insurance
- Estérel Aventures has taken out professional civil liability insurance with COVEA RISKS, under contract no. 120134036.
- Estérel Aventures has taken out Personal Accident Insurance with ALBINGUA under contract no. IA1500503.
- The equipment provided is covered by third-party insurance. Any breakage or damage will be invoiced to the customer, as will any related legal costs/proceedings.
The hirer is responsible for the use of and damage to the equipment. The hirer is responsible for all costs incurred as a result of such damage. However, the hirer may not be held liable for the harmful consequences of any hidden defects in the equipment that render it unfit for its intended use, provided that the hirer provides proof of the said defects. The hirer undertakes to pay the cost of repairs within 10 days of receipt of the invoice.
Image rights
Unless you inform us in writing that you do not wish us to do so, we may take photographs during your event for non-commercial purposes.
It should be noted that only “recognizable” persons may invoke their right to image and privacy.
Jurisdiction
Any dispute or claim must be sent to ESTEREL AVENTURES by registered letter with acknowledgement of receipt within eight days of the end of the event organized. After this deadline, no dispute or claim will be considered valid. In the event of a dispute, and in the absence of an amicable agreement, the courts having jurisdiction over the head office of ESTEREL AVENTURES will have sole competence.
The client undertakes to pay for any damage, breakage or costs inherent in any proceedings taken against him/her, even retroactively.
Penalties may be applied for any costs inherent in a recovery procedure.
